Indoor smoking areas allowed in Duterte smoking ban

DAVAO CITY, May 19, 2017 — President Rodrigo Duterte has appeared to have reached a compromise with businesses after an executive order banning smoking nationwide was signed nationwide.

Executive Order No. 26, which was signed by President Duterte this week, includes an indoor designated smoking area as one of the provisions in the long-awaited presidential measure.

The ordinance is loosely based on Davao City’s Comprehensive Anti-Smoking Ordinance, Ordinance No. 0367, series of 2012.

The Davao version does not allow for indoor smoking areas.

However, since the national law, Republic Act 9211, does not expressly prohibit smoking indoors through smoking areas, President Duterte’s EO allows it provided several considerations.

The indoor smoking area need only have a buffer zone that separates the smoking area itself to the entry point of the building.

The building’s exhause system for smoke coming from indoor smoking areas should also be separate from the building’s main ventilation system.

News of the EO first broke when agriculture secretary Manny Pinol leaked that President Duterte was already considering signing the EO.

In a recent visit to Davao City, health secretary Paulyn Jean Ubial said President Duterte was still finalizing the document.

Duterte’s EO 26, meanwhile, also disallows the smoking of vapes, shishas, and hookas in public places, much like in Davao City.
